EXP Tube Terms of Service & Privacy Policy
EXP Tube is a video platform with a live multiplayer game attached. You can watch and upload videos, broadcast live, play inside creators' worlds, and send or receive money. This page covers both the rules for using EXP Tube (Part A) and what we do with your information (Part B).
Part A — Terms of Service
1. Accepting these Terms
By creating an account, uploading, broadcasting, playing, or paying on EXP Tube, you agree to these Terms and to the Privacy Policy in Part B. If you do not agree, do not use the service.
Separate terms sit alongside this document:
- The Livestream Terms and Safety Agreement, which you accept before broadcasting.
- Any advertiser terms shown when buying advertising.
- Stripe's terms, which govern payments and payouts.
2. Who may use EXP Tube
- You must be at least 13 years old to hold an account.
- If you are under 18, you may not receive payouts or buy paid features without a parent or guardian's consent, and they accept these Terms with you.
- You must be at least 18 to receive money as a creator.
- You must not be barred from using the service under the laws that apply to you.
3. Your account
You are responsible for everything done under your account, including by anyone you allow to use it. Keep your credentials private and tell us promptly if your account may be compromised.
We may suspend or close an account that breaks these Terms, creates legal risk, or harms other users.
4. Your content
You keep ownership of the videos, streams, images, names and other material you upload ("Your Content").
You grant EXP Tube a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for delivery, transcode, display, distribute and promote Your Content for the purpose of operating and promoting the service. This licence ends when you delete the content, except for copies already distributed, retained in backups, or required by law.
You promise that you own or have permission to use everything in Your Content, including music, footage, images, brands, and anyone appearing in it.
5. What you may not do
- Upload or broadcast content that is illegal, sexually explicit, violent, hateful, harassing, or that endangers children.
- Post content you do not have the rights to, including copyrighted music and video.
- Impersonate others or misrepresent your identity or affiliation.
- Break, probe or overload the service, the game servers, or other users' access.
- Cheat, exploit bugs, automate gameplay, or manipulate rewards, currency or rankings.
- Use EXP Tube for fraud, laundering money, or evading sanctions.
- Collect other users' personal information without their consent.
6. Live streaming
Broadcasting is also governed by the Livestream Terms and Safety Agreement you accept before going live. You are responsible for everything shown, said, or done on your stream, including by guests and anything visible on your screen or in your room.
Streams may be recorded, saved as replays, and turned into short clips on the platform.
7. The game, worlds and virtual items
EXP Tube includes a multiplayer game with maps, monsters, items, coins and other virtual goods. All of it is licensed, not sold, and:
- has no cash value and cannot be redeemed for money;
- may be changed, rebalanced, or removed at any time;
- does not survive account closure.
Creators can shape their own worlds, including spawning monsters and enabling paid interactions. Creators are responsible for how they use those controls.
8. Paying on EXP Tube
- Payments are processed by Stripe. We do not store your card details.
- Prices are shown before you pay and charged in the currency displayed.
- Payments are final and non-refundable except where the law requires otherwise, or where a paid interaction failed to be delivered.
- Subscriptions renew automatically until cancelled. Cancelling stops the next renewal; it does not refund the current period.
- Paying a creator is not a purchase from EXP Tube of anything beyond the described in-platform effect.
9. Getting paid as a creator
- Payouts require a connected Stripe account. Stripe verifies your identity and holds your bank details; EXP Tube never sees them.
- EXP Tube deducts a platform fee, disclosed before you enable payouts. Stripe's processing fees also apply.
- You are responsible for your own taxes on money you receive.
- We may withhold, reverse or delay a payout connected to fraud, chargebacks, or a breach of these Terms.
- Chargebacks and refunds may be deducted from your balance.
10. Copyright
We respond to valid copyright complaints and may remove content and terminate repeat infringers. To make a claim, send us: identification of the work, its location on EXP Tube, your contact details, a statement that you believe the use is unauthorised, and a statement made under penalty of perjury that your claim is accurate and you are authorised to act.
11. Moderation and enforcement
We may remove content, limit features, suspend monetization, or close accounts where we reasonably believe these Terms have been broken, or to protect users or the service. Where practical we will explain why.
12. Service changes and availability
EXP Tube is under active development. Features may change or be withdrawn and the service may be unavailable at times. We do not guarantee uninterrupted access, or that content or game progress will be preserved indefinitely.
13. Disclaimers
The service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We are not responsible for content posted by users.
14. Limitation of liability
To the fullest extent permitted by law, EXP Tube is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill or virtual items. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars. Nothing here excludes liability that cannot lawfully be excluded.
15. Indemnity
You agree to indemnify EXP Tube against claims, damages and costs arising from Your Content, your use of the service, or your breach of these Terms.
16. Ending your use
You may stop using EXP Tube and close your account at any time. Provisions that by their nature should survive — licences already granted, payment obligations, disclaimers, limitation of liability and indemnity — continue after closure.
17. Changes to these Terms
We may update this document. If a change is material we will give notice on the service before it takes effect. Continuing to use EXP Tube afterwards means you accept the update.
Part B — Privacy Policy
This explains what personal information EXP Tube collects, why, who we give it to, and what control you have. Please read section B4 carefully — we sell and share personal information for advertising.
B1. Information we collect
Information you give us
- Account — email address, username, display name, password (stored hashed by Firebase Authentication), profile picture, banner, channel description.
- Content — videos, live streams, thumbnails, chat messages, and anything visible or audible in what you upload or broadcast.
- Creator payout details — collected and held by Stripe, not by us. We store only your Stripe account identifier and whether you are able to accept charges and receive payouts.
- Communications — messages you send us, and reports you file.
Information created as you use EXP Tube
- Viewing activity — videos and streams watched, how long, what you searched for, what you clicked.
- Game data — character, level, experience, stats, inventory, coins, maps visited, monsters defeated, sessions and time played.
- Payment metadata — amounts, currency, time, what was bought, and Stripe's identifiers. We never receive or store your full card number.
- Advertising activity — which ads were shown to you, whether they were viewed or skipped, and whether you clicked.
- Device and technical data — IP address, browser and version, operating system, device type, screen size, language, and approximate location derived from IP.
- Cookies and similar technologies — see B5.
Information from third parties
- Sign-in providers such as Google, if you use them — your email, name and profile picture.
- Advertising and analytics partners, who may give us information about audience segments and ad performance.
B2. How we use it
- To run the service: accounts, uploads, playback, streaming, chat and the game.
- To process payments and creator payouts.
- To personalise what you see, including recommendations and search results.
- To select, deliver, measure and improve advertising, including profiling for ad targeting.
- To keep EXP Tube safe: fraud detection, abuse prevention, moderation and enforcement.
- To analyse and improve the product.
- To comply with law and to establish, exercise or defend legal claims.
Where the GDPR applies, our lawful bases are: contract (running your account and paying creators), legitimate interests (security, abuse prevention, product improvement), legal obligation (tax, law enforcement), and consent (advertising cookies, and any sale or sharing of personal information). You may withdraw consent at any time.
B3. Advertising and profiling
EXP Tube is supported by advertising. Ads may be shown before or around videos and inside the game.
We and our advertising partners use your viewing activity, game activity, device data and inferred interests to build an advertising profile and choose which ads you see, and to measure whether they worked. This is automated profiling for marketing purposes.
You can object to or opt out of this — see B6 and B7. Opting out does not remove ads; it makes them less relevant.
B4. Selling and sharing your information
EXP Tube sells and shares personal information. Under California law, "sell" means disclosing personal information to a third party for money or other value, and "share" means disclosing it for cross-context behavioural advertising. We do both.
Categories we sell or share: identifiers (such as advertising IDs, cookie IDs and IP address), internet and network activity (viewing history, ad interactions, search terms), device and approximate location data, and inferences drawn from these (interest and audience segments).
Who we sell or share it with: advertising networks, demand-side and supply-side platforms, measurement and analytics providers, and data partners who build audience segments.
Why: to fund the platform through advertising and to make advertising more relevant and measurable.
What we do not sell or share: your password, your payment card details (we never hold them), the contents of your private communications with us, or creator identity documents held by Stripe.
Minors. We do not knowingly sell or share the personal information of users we know to be under 16 without opt-in consent from them or, for users under 13 who should not have an account at all, their parent or guardian. If you are under 16, we will treat you as having opted out unless you tell us otherwise.
You have an absolute right to opt out. See B6.
B5. Cookies and similar technologies
We use cookies, local storage and similar technologies to:
- keep you signed in and remember settings such as your video window position (strictly necessary);
- measure how the service is used (analytics);
- select and measure advertising, including across sites (advertising).
Strictly necessary storage cannot be turned off without breaking the service. You can control the rest through your browser and through the opt-out in B6. Blocking all storage will sign you out and lose game settings held locally.
B6. Do Not Sell or Share My Personal Information
You may opt out of the sale and sharing of your personal information, and of targeted advertising, at any time. You do not need an account to do this and we will not treat you differently for doing it.
- Email kenyonkenvlogs@gmail.com with the subject "Do Not Sell or Share My Personal Information".
- Global Privacy Control — if your browser sends a GPC signal, we treat it as a valid opt-out for that browser.
We will action a request within the period required by law, and confirm when it is done.
B7. Your rights
If you are in the EU or UK (GDPR) you have the right to: access your data; correct it; erase it; restrict or object to processing, including profiling for direct marketing; data portability; and withdraw consent. You may also complain to your data protection authority.
If you are in California (CCPA/CPRA) you have the right to: know what is collected, used, sold and shared; delete it; correct it; opt out of sale, sharing and targeted advertising; limit use of sensitive personal information; and not be discriminated against for exercising these rights.
To exercise any right, email kenyonkenvlogs@gmail.com. We may need to verify your identity, and we will respond within the time the law allows. An authorised agent may act for you with proof of authority.
B8. Who we share information with
Beyond the advertising partners in B4, we use service providers who process data on our behalf:
- Google Firebase — authentication, database, file storage, hosting, serverless functions.
- Stripe — payments, creator identity verification and payouts.
- Bunny.net — video storage, encoding and delivery.
- Cloudflare — live stream ingest and delivery.
- Railway — the multiplayer game server.
- Transcription and media-processing providers used to generate clips and captions.
We also disclose information where required by law, to enforce our Terms, to prevent fraud or harm, and as part of a merger, acquisition or sale of assets — in which case we will tell you.
B9. Retention
We keep account and content data while your account is open. When you delete content it is removed from the service, though copies may persist briefly in backups. When you close your account we delete or anonymise your personal information within a reasonable period, except where we must keep records for tax, accounting, fraud prevention or legal claims — payment records in particular are typically retained for several years.
B10. Security
We use industry-standard measures including encryption in transit, hashed passwords, and access controls. No service can promise perfect security. If a breach affects your personal information we will notify you and the regulators where required.
B11. International transfers
EXP Tube and its providers operate in the United States and elsewhere. If you are outside the US, your information will be transferred to and processed in countries whose data protection laws may differ from your own. Where required we rely on appropriate safeguards such as the EU Standard Contractual Clauses.
B12. Children
EXP Tube is not for children under 13 and we do not knowingly collect their personal information. If we learn we have, we will delete it and close the account. Parents or guardians who believe a child under 13 has given us information should contact us.
B13. Changes to this Policy
We may update this Policy. Material changes will be notified on the service before they take effect. The "last updated" date at the top always reflects the current version.
